2. Commercial information and images
The information on this website is provided as a general guide for prospective buyers and does not constitute an offer, guarantee or pre-contractual agreement. The floor areas, images, renders, plans, layouts, specifications, dates, services and other elements shown on this website are indicative and may change for technical, commercial, regulatory, administrative, licensing, permitting or construction reasons.
The floor areas published are indicative and have been rounded; the final floor areas will be those resulting from the measurement set out in the contractual documentation and may not exactly match those published here.
Images, renders and graphic representations are purely illustrative and non-contractual. Furniture, decoration, textiles, artworks, non-fixed lighting, accessories and other styling elements shown are not included in the price unless expressly stated. The information is correct as of its publication on this website, errors and omissions excepted, and may be modified subsequently. The legally required documentation will be made available to interested parties under the terms provided for in the applicable regulations.
The total or partial reproduction, distribution or communication of the contents of this website without express authorisation is strictly prohibited. The texts, photographs, images, logos and other original content on this website are protected by current legislation.
3. Data controller
The controller of the personal data collected on this website is LXH ESTATE, S.L., which operates under its registered trademark RHAIGA, with the contact details given in section 1. You may contact us about any matter relating to the processing of your personal data at casaayala63@rhaiga.com.
4. What data we collect and why
Through the forms on the website (information request and floor plan download) we collect your name, telephone number, email address, the type of residence you are interested in and, if you choose to provide it, a comment.
If your interest progresses towards a viewing, an offer, a reservation or the purchase of a residence, we may also collect the identification, contact and documentary data needed to manage the transaction and comply with our legal obligations.
We use your data, first, to inform you about the Casa Ayala project: to let you know about its launch, provide you with documentation, arrange viewings and respond to your interest in the residences and, where applicable, to manage the reservation and purchase of the residence you are interested in, which includes disclosing your data to the Owner under the terms of section 6.
Second, and only if you authorise it by ticking the specific box provided for this purpose in the form —which is optional, and leaving it unticked does not prevent us from responding to your request—, RHAIGA will use your data to send you, by email, telephone, instant messaging or other equivalent electronic means, commercial information about other homes and properties it markets from time to time that may match your profile of interest. To this end, we may take into account the type of interest and preferences you have indicated, without in any case taking decisions based solely on automated processing that produce legal effects concerning you or similarly significantly affect you.
Likewise, where your interest results in a purchase transaction, we will process the data necessary to comply with the due diligence obligations imposed on LXH ESTATE, S.L., as an obliged entity, by Spanish Law 10/2010, of 28 April, on the prevention of money laundering and terrorist financing.
Outside the cases described in this section, we do not use your data for any other purpose, nor do we disclose it to third parties for their own commercial purposes.
5. Legal basis
Responding to your request for information and, where applicable, managing the viewing, reservation and purchase of the residence, including disclosing your data to the Owner for this purpose, are based on taking steps at your request prior to entering into a contract and, where appropriate, on the performance of the corresponding contract (Article 6(1)(b) of Regulation (EU) 2016/679, the General Data Protection Regulation, hereinafter “GDPR”).
The information we provide to the Owner on the progress of the marketing is also based on the legitimate interest of RHAIGA and of the Owner in the proper performance and supervision of the marketing mandate (Article 6(1)(f) GDPR), to which you may object at any time.
Sending commercial communications about other properties marketed by RHAIGA is based exclusively on your consent (Article 6(1)(a) GDPR and Article 21 of Spanish Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce), which you give by ticking the specific box provided for this purpose. You may withdraw it at any time by writing to casaayala63@rhaiga.com or through the simple, free unsubscribe procedure included in each communication, without this affecting the lawfulness of prior processing or our response to your request for information.
The processing of the data necessary for due diligence in the prevention of money laundering and terrorist financing is based on compliance with a legal obligation (Article 6(1)(c) GDPR, in connection with Law 10/2010, of 28 April).
6. Recipients
Your data may be disclosed to the following recipients:
- The Owner, which will process your data as an independent controller, solely for the purpose of managing the transaction relating to the Casa Ayala residence you are interested in and supervising its marketing, and may not use it to send you commercial communications unrelated to the project unless it first obtains your consent. The identity of the Owner will be provided to you when your interest results in a specific transaction or, at any time, if you request it in exercise of your right of access.
- The technology provider that forwards form submissions to our enquiries mailbox, as well as other technology service providers (web hosting, email and, where applicable, customer management tools) and the professional collaborators who provide RHAIGA with sales support services, who act as data processors under the corresponding contract in accordance with Article 28 GDPR and do not keep the data for their own purposes.
- The notaries, financial institutions and other professionals involved in formalising the purchase, where necessary for this purpose.
- The public administrations, courts and tribunals and the Executive Service of the Commission for the Prevention of Money Laundering and Monetary Offences (SEPBLAC), in the cases provided for by law.
As a general rule, your data is processed within the European Economic Area. Where a provider may access it from outside that area, the international transfer is covered by an adequacy decision of the European Commission, including the EU-US Data Privacy Framework, or by the standard contractual clauses approved by the Commission (Articles 45 and 46 GDPR). You may request information about these safeguards at the contact address given.
7. Retention
We will keep the data processed to respond to your request for as long as the marketing phase of Casa Ayala lasts and, where applicable, until the corresponding transaction is completed, or until you request its erasure. Data processed for sending commercial communications will be kept until you withdraw your consent or, in any case, for a maximum of twenty-four (24) months from your last interaction with RHAIGA, after which we may ask you to renew it. Data collected in compliance with anti-money laundering regulations will be kept for ten (10) years, in accordance with Article 25 of Law 10/2010. Once the above periods have elapsed, the data will be blocked for the legally required periods, under the terms of Article 32 of Spanish Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights, solely for the purpose of addressing any possible liabilities, and will then be deleted.
8. Your rights
You may exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw the consent given at any time, by writing to casaayala63@rhaiga.com or to the controller's postal address, providing proof of your identity. We will respond to your request within one month, which may be extended under the terms of Article 12(3) GDPR. If you consider that the processing does not comply with the regulations, you may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).
